Bad Faith, Unfair Practices Act Claims Properly Dismissed Against Auto Insurer

Mealey's (December 3, 2020, 12:42 PM EST) -- ALBUQUERQUE, N.M. — The New Mexico Court of Appeals on Nov. 30 affirmed a trial court’s dismissal of claims alleging that an auto insurer acted in bad faith and committed unfair practices when it denied the insured’s claim for the theft of his car because the insurer provided the insured with sufficient documents informing him that coverage for theft was not available after he dropped comprehensive coverage for the car (David Shaykin v.
