U.S. High Court Grants Certiorari, Remands Clean Water Case To 4th Circuit

Mealey's (May 4, 2020, 10:29 AM EDT) -- WASHINGTON, D.C. — The U.S. Supreme Court on May 4 granted certiorari in a groundwater contamination case in order to remand it to the Fourth Circuit U.S. Court of Appeals for further consideration in light of the high court’s ruling in County of Maui v. Hawaii Wildlife Fund, which held that a National Pollutant Discharge Elimination System (NPDES) permit is needed only if a discharge comes directly from a point source or when there is “the functional equivalent of a direct discharge” (Kinder Morgan Energy, et al. v. Upstate Forever, et al., No. 18-268, U.S. Sup.)....
