California Appeals Court: Sovereign Immunity Does Not Bar Retaliation Claims

Mealey's (June 24, 2015, 10:33 AM EDT) -- SANTA ANA, Calif. — In reversing a lower court decision, a California state appeals panel on May 28 held that sovereign immunity does not bar claims against tribal officials alleging that they exceeded their authority by using their official position to revoke the gaming license of a casino employee who had served as a confidential informant into illegal activities at the casino (Benedict Cosentino v. Stella Fuller, et al., No. G050923, Calif. App., 4th Dist., Div. 3; 2015 Cal. App. LEXIS 465).
