Immunity Bars Claims Against Alabama Tribe’s Casino, Judge Rules

Mealey's (June 20, 2016, 3:02 PM EDT) -- MOBILE, Ala. — A patron of an Indian casino in Alabama cannot pursue claims that the casino violated federal law when it banned her from the premises because the casino is protected by the tribe’s sovereign immunity, and the longtime doctrine from Ex parte Young (209 U.S. 123 [1908]) cannot save her claims, a federal judge held June 15 (Catrina Johnson v. Wind Creek Casino, No. 16-0052, S.D. Ala.; 2016 U.S. Dist. LEXIS 77804).
