Texas Court Asked To Reconsider If 9-Year Delay Doomed Acceptance Of Settlement

(April 29, 2016, 4:50 PM EDT) -- HOUSTON — Union Carbide Corp. warned a Texas appellate panel April 12 that it “risks creating a dangerous precedent” by finding that the passage of nine years before plaintiffs accepted an asbestos settlement offer wasn’t fatal to their claim (Union Carbide Corp. v. Perry Jones, Rosemary Allegria, et al., No. 01-14-00574-CV, Texas App., 1st Dist.; 2016 Tex. App. LEXIS 3182).
