Mealey's (August 4, 2022, 12:48 PM EDT) -- CHICAGO — Affirming a trial court, a Seventh Circuit U.S. Court of Appeals panel on Aug. 1 ruled that participants in an employee stock ownership plan (ESOP) did not meet the pleading standards outlined in Fifth Third Bancorp v. Dudenhoeffer and that because investment decisions were delegated to an independent fiduciary, The Boeing Co. and associated defendants “cannot be liable for breaching fiduciary duties” under the Employee Retirement Income Security Act “that they simply did not have.”...
