2nd Circuit Panel Reinstates Individual, Not Class Claims In Debt Collection Suit
(March 3, 2016, 11:12 AM EST) -- NEW YORK — The Second Circuit U.S. Court of Appeals on Feb. 22 vacated the dismissal of individual federal claims brought by a consumer who alleges that a debt collector violated the Fair Debt Collection Practices Act (FDCPA) with the wording of its debt collection letter; however, the panel affirmed the denial of class certification (Jeffrey J. Gallego, et al. v. Northland Group Inc., et al., No. 15-1666, 2nd Cir.; 2016 U.S. App. LEXIS 3025).
