Idaho Supreme Court Affirms Water Rights Holder Can Tap Into Neighbor’s Pipeline

Mealey's (June 17, 2015, 1:51 PM EDT) -- BOISE, Idaho — The Idaho Supreme Court on April 1 affirmed a trial court’s decision to allow a couple to tap a water pipeline that crosses their property but vacated the lower court’s ruling that the couple had to pay an annual water delivery fee (Daryl K. Mullinix, et al. v. Killgore’s Salmon River Fruit Co., et al., No. 41583, 2015 Opinion No. 37, Idaho Sup.; 2015 Ida. LEXIS 94).
