Federal Circuit Says Patents Not Infringed But Not Invalid

Mealey's (March 1, 2016, 2:07 PM EST) -- WASHINGTON, D.C. — A final judgment of noninfringement and patent invalidity was partly affirmed March 1 by the Federal Circuit U.S. Court of Appeals (UltimatePointer LLC v. Nintendo Co. Ltd., No. 15-1297, Fed. Cir.).

According to the appellate panel of Circuit Judges Alan D. Lourie, Evan J. Wallach and Timothy Dyk, although Nintendo Co. Ltd. was entitled to prevail on allegations that it infringed a handheld pointer patent, a Washington federal judge erroneously deemed the patent indefinite.
