City Says Texas High Court Shouldn’t Decide If ‘Water Accommodation’ Exists

Mealey's (June 17, 2015, 12:21 PM EDT) -- AUSTIN, Texas — The City of Lubbock, Texas, on Dec. 5 told the Texas Supreme Court that it lacks jurisdiction to hear an appeal over an injunction against proposed water wells and said the court should not take up the appeal to decide if the state’s oil-and-gas accommodation rule should be applied to water rights (Coyote Lake Ranch, LLC v. The City of Lubbock, No. 14-0572, Texas Sup.).
