New York Supreme Court Justice: Highway Use Taxes Are Unconstitutional
(February 4, 2016, 8:24 AM EST) -- ALBANY, N.Y. — Two provisions of New York State’s Tax Law Section 502 that require the payment of fees by certain vehicles operating on public highways in the state are unconstitutional, a New York justice ruled Jan. 22, granting summary judgment to a class of plaintiffs challenging the fees (Owner Operator Independent Drivers Association, et al. v. New York State Department of Taxation and Finance, et al., No. 5551-13, N.Y. Sup., Albany Co.).
