California Appeals Court:Tiered Water Rates Must Be Tied To Cost Of Service

Mealey's (June 17, 2015, 11:21 AM EDT) -- SANTA ANA, Calif. — A California appeals court panel on April 20 said a four-tier water pricing structure by the City of San Juan Capistrano violates the state constitution because the prices are not based on the cost of water service (Capistrano Taxpayers Association, Inc. v. City of San Juan Capistrano, No. G048969, Calif. App., 4th Dist., Div. 3; 2015 Cal. App. LEXIS 330).
