Bankruptcy Court Judge Allows Limited Discovery Into Possible Defects Claims
Mealey's (February 2, 2016, 2:53 PM EST) -- TRENTON, N.J. — A federal bankruptcy court judge in New Jersey on Jan. 19 allowed a homeowners association and the new owner of a condominium complex to engage in limited discovery to determine if the plaintiffs knew about alleged construction defects in the facility’s common areas prior to the new owner’s purchase of the property (In re: Kara Homes Inc., No. 06-19626, N.J. Bkcy.; 2016 Bankr. LEXIS 191).
