Kellogg Labeling Settlement Valued At $31.5 Million Denied Preliminary Approval

Mealey's (February 25, 2020, 2:04 PM EST) -- SAN JOSE, Calif. — A California federal judge on Feb. 20 denied preliminary approval of a settlement the plaintiffs in a labeling settlement value at $31.5 million, ruling that the voucher portion of the settlement constitutes a coupon settlement under the Class Action Fairness Act (CAFA), that release of claims was overbroad, that the structure of the settlement was inappropriate, that the appropriateness of class certification and reversion of funds to Kellogg were unclear and that the claim form, opt-out form and notice forms all contained errors (Stephen Hadley, et al. v.
