Ohio Panel: Man’s Will Did Not Have Clear Intent Of Survivorship Tenancy

Mealey's (December 15, 2019, 10:39 AM EST) -- LIMA, Ohio — An Ohio appeals court panel on Dec. 2 upheld a probate court judge’s ruling that a deceased woman’s heirs are entitled to her share of her stepfather’s estate, holding that there was no clear intent in the man’s will that his stepdaughter’s shares of the estate were immediately vested to her upon his death and that there is no evidence that he intended to create joint tenancy among her and her siblings (In re:  Estate of Gaskill, No. 1-19-15, Ohio App., 3rd Dist., 2019 Ohio App. LEXIS 4984)....
