Federal Judge Says Insured’s Claim For Emotional Distress Damages Cannot Stand

Mealey's (November 11, 2019, 1:26 PM EST) -- TACOMA, Wash. — A Washington federal judge on Nov. 7 granted a homeowners insurer’s motion for partial summary judgment on a homeowners’ claim for emotional distress damages caused by the insurer’s refusal to pay for all of the water and mold damages sustained in the insured’s home after determining that emotional distress damages are not recoverable on a breach of contract claim (Vanessa Camper v.
