High Court Should Wait Before Ruling On Petition In Breach Of Fiduciary Duty Suit

(October 22, 2019, 5:40 PM EDT) -- WASHINGTON, D.C. — The U.S. Supreme Court should hold a plaintiff’s petition for writ of certiorari in a suit alleging that a retirement plan breached its fiduciary duty by continuing to offer stock of the employer’s former parent company until the high court issues a ruling in a pending case before the high court because the outcome of the pending case may affect how the high court’s precedent regarding pleadings requirements should be implemented, the plaintiff says in an Oct. 2 petition for writ of certiorari (Alexander Y.
