Washington Appeals Court Says Generic Reglan Makers Entitled To Summary Judgment

Mealey's (May 1, 2019, 2:46 PM EDT) -- TACOMA, Wash.— A Washington appeals panel on April 30 vacated a trial judge’s ruling denying a motion for summary judgment filed by three makers of a generic version of the heartburn drug Reglan, finding that the learned intermediary doctrine barred the plaintiffs’ claim for failure to warn and that the woman’s doctor admitted that he did not read the warning about the risk of tardive dyskinesia when prescribing the drug (Diana Sherman, et al. v.
