3rd Circuit Reinstates State Employee’s 1st Amendment Claim For Speech
(November 5, 2015, 11:27 AM EST) -- PHILADELPHIA — The Third Circuit U.S. Court of Appeals on Oct. 14 reinstated a First Amendment to the U.S. Constitution retaliation claim filed by a former Delaware state employee who alleges that her employment was terminated after she made gender discrimination claims (Mary Fender v. Delaware Division of Revenue, et al., No. 14-4140, 3rd Cir.; 2015 U.S. App. LEXIS 17843).
