ICSID Seeks PCA Assistance, Rejects Germany’s Request To Disqualify

Mealey's (March 14, 2019, 2:23 PM EDT) -- WASHINGTON, D.C. — Based on a recommendation from the secretary-general of the Permanent Court of Arbitration (PCA) and other factors, the acting chairman of the International Centre For Settlement of Investment Disputes (ICSID) Administrative Council on March 11 made public a decision denying a request by the Federal Republic of Germany to disqualify the tribunal hearing an arbitration filed against it under the Energy Charter Treaty (ECT), holding that Germany failed to show that the members manifestly lacked the qualities required of an arbitrator  (Vattenfall AB and others v.
