Insured Is Permitted To Stack Limits Of Primary Policy, Panel Determines

(October 29, 2018, 11:33 AM EDT) -- ATLANTA — The Georgia appellate panel on Oct. 26 determined that an insured seeking coverage for underlying asbestos liability claims is permitted to stack the limits of each primary policy at issue because the noncumulation provisions, added in the final two policies issued to the insured, are ambiguous as to whether they applied retroactively to all the primary policies issued to the insured (National Union Fire Insurance Company of Pittsburgh, Pa., et al. v.
