Split En Banc 9th Circuit Reinstates Workers’ Tip Credit Suit Against Restaurants

(September 19, 2018, 1:20 PM EDT) -- SAN FRANCISCO — A split en banc Ninth Circuit U.S. Court of Appeals on Sept. 18 ruled that servers and bartenders suing various restaurants where they were employed for allegedly improperly taking the Fair Labor Standards Act’s (FLSA) top credit, even though the workers spent more than 20 percent of their time on nontipped activities, may proceed with their claims, reversing a trial court’s judgments (Alec Marsh v.
