Judge Reject’s Insurer’s Challenges To Wrongful Death Suit Proceeding In California

(August 9, 2018, 1:53 PM EDT) -- SAN DIEGO — After finding that an insurer availed itself of a California forum when it approved medical care for a Medicare beneficiary who allegedly died there while waiting for a lung transplant, a California federal judge on July 26 refused to dismiss the case for lack of personal jurisdiction and improper venue and denied a request to transfer the case to Utah (Naomi Aylward, et al. v. SelectHealth Inc., et al., No. 18cv494, S.D. Calif., 2018 U.S. Dist. LEXIS 125497).
