Car Dealer Is Barred From Relitigating Whether Ohio Auto Dealer Law Is Preempted

(April 9, 2018, 1:56 PM EDT) -- CINCINNATI — The Sixth Circuit U.S. Court of Appeals on April 4 affirmed a district court’s ruling that a car dealer is barred from relitigating whether a federal law enacted in response to the bankruptcy of Chrysler LLC preempts an Ohio law governing the relationship between automobile manufacturers and dealers because the car dealer had the opportunity to litigate the issue in a prior lawsuit but failed to do so (FCA US LLC et al., v.
