6th Circuit Finds Estate Was Not Bound By Nursing Home’s Arbitration Agreement

(March 27, 2018, 2:08 PM EDT) -- CINCINNATI — The Sixth Circuit U.S. Court of Appeals on March 22 affirmed a district court’s decision to deny a nursing home’s motion to compel arbitration of wrongful death and negligence claims asserted by an estate, finding that a deceased resident declined arbitration when he signed a second admissions agreement that superseded a previous contract that required arbitration (GGNSC Louisville St. Matthews LLC, dba Golden Living Center – St. Matthews, et al. v.
