Pa. High Court Majority Reverses Ruling On Wife’s Entitlement To Trust Assets

Mealey's (December 22, 2017, 11:24 AM EST) -- HARRISBURG, Pa. — The majority of the Pennsylvania Supreme Court on Dec. 19 reversed a lower court’s ruling that a decedent’s second wife, not named as a beneficiary in the decedent’s inter vivos trust, is entitled to a share of the trust pursuant to Section 2507 of Pennsylvania’s Probate, Estates and Fiduciaries (PEF) Code because Section 7710.2 of the PEF Code, enacted in 2006, does not compel the inclusion of the trust (In re: Trust Under Deed of David Kulig dated Jan. 12, 2001, No. 97-2016, Pa.
