Texas Appeals Panel Reverses; ‘Unforeseeable Incapacity’ Defense Was Misunderstood

(September 8, 2015, 9:48 AM EDT) -- WACO, Texas — An appeals panel in Texas on Aug. 27 reversed and remanded a case involving injuries from an auto accident on grounds that the trial court erred in dismissing the matter and the defendant misunderstood “unforeseeable incapacity” as a defense (Robert Williams v. Russell Parker, No. 10-14-00349, Texas App., 10th Dist.).
