Mirena MDL Judge: No Res Judicata Bar For Plaintiff’s Other Case

(September 2, 2015, 12:05 PM EDT) -- NEW YORK — A New York federal judge, sitting as a Missouri court and applying federal common law to a decision the judge made while sitting as a California court, ruled Aug. 26 that a Mirena plaintiff is not barred by res judicata from maintaining her second compliant filed in Missouri state court (In Re: Mirena IUD Products Liability Litigation, MDL Docket No. 2434, Ashley Brown v. Bayer Healthcare Pharmaceuticals Inc., No. 14-4876, S.D. N.Y.; 2015 U.S. Dist. LEXIS 113588).
