Judge Finds Patient Did Not Agree To Arbitrate Claims Against Manor Care

(September 12, 2017, 2:14 PM EDT) -- NEW CASTLE, Del. — After finding that a patient never signed an agreement to arbitrate disputes with a rehabilitation facility, a Delaware judge on Aug. 15 denied a motion filed by the facility to dismiss claims for negligence against it and to stay the case in favor of arbitration (Bridget Hylak, et al. v. Manor Care Pike Creek of Wilmington, DE, LLC, No. N17C-04-148, Del. Super., 2017 Del. Super. LEXIS 393).
