Magistrate Recommends Breach Of Fiduciary Duty Claims Proceed Against University

Mealey's (September 11, 2017, 4:22 PM EDT) -- BOSTON — A federal magistrate judge in Massachusetts on Aug. 31 recommended denying in part and granting in part a motion to dismiss claims brought against a university and its defined contribution plan alleging breach of fiduciary duty and prohibited transactions under the Employee Retirement Income Security Act.  Participants of the plan claimed that actions by the plan’s third-party administrator resulted in losses to the participants’ retirement savings (David B.
