Judge: MTBE Design Defect Claim Reconsidered, Allowed Based On Overlooked Evidence

(August 26, 2015, 12:34 PM EDT) -- NEW YORK — The federal judge presiding over the methyl tertiary butyl ether (MTBE) groundwater contamination lawsuit brought by the Commonwealth of Puerto Rico against Shell Oil Co. on Aug. 19 granted the commonwealth’s motion for reconsideration of its design defect claim, ruling that she had overlooked evidence when she initially dismissed that claim (In re: Methyl Tertiary Butyl Ether [MTBE] Products Liability Litigation, MDL 1358, No. 00-1898, Commonwealth of Puerto Rico v.
