Class Action Over Anthem’s Data Breach Remanded To California State Court

(August 26, 2015, 12:07 PM EDT) -- LOS ANGELES — A California federal judge on Aug. 13 granted an insured’s motion to remand her breach of contract and bad faith putative class claims related to the breach of her insurer’s database, finding that the plaintiff intended the complaint to apply only to California citizens and California statutes (Debra Smilow, et al. v. Anthem Blue Cross Life and Health Insurance Co., No. 2:15-cv-04556, C.D. Calif.; 2015 U.S. Dist. LEXIS 107447).
