Homeowners Argue To 5th Circuit: Insurer Has Duty To Indemnify Award

(August 17, 2015, 12:54 PM EDT) -- NEW ORLEANS — An insurer has a duty to indemnify an underlying default judgment against an insured because property damage in the form of cracks in a home occurred during the policy period and the “your work” exclusion does not apply to bar coverage, homeowners argue in a June 24 reply brief to the Fifth Circuit U.S. Court of Appeals (James Feaster, et al. v. Mid-Continent Casualty Co., No. 15-20074, 5th Cir.).
