Pension Plan Participants: Fiduciaries Could Revert To Alleged Illegal Activities

LOUIS — U.S. Bancorp pension plan participants filed a reply brief Oct. 13 with the Eighth Circuit U.S. Court of Appeals, saying that a Minnesota federal judge erred in dismissing as moot and time-barred their putative class action alleging violations of the Employee Retirement Income Security Act because there is no assurance that the plan fiduciaries will not revert to their allegedly illegal actions (Sherry Smith, et al. v. U.S. Bank, et al., No. 0:13-cv-02687, 8th Cir.)....
