Judge Finds TILA And RESPA Claims Are Barred By Rooker-Feldman

Mealey's (November 17, 2016, 6:00 PM EST) -- NEWARK, N.J. — A New Jersey federal judge on Nov. 16 found that a borrower's claims for violation of the Truth in Lending Act (TILA) and the Real Estate Settlement Procedures Act (RESPA) were barred by  the doctrine established in Rooker v. Fidelity Trust Co. (263 U.S. 413 [1923]) and District of Columbia Court of Appeals v. Feldman (460 U.S. 462 [1983]), granting a motion to dismiss the case (Maureen Dunbar v.
