California Judge Tentatively Denies City Eminent Domain Over Water Company

(November 11, 2016, 1:48 PM EST) -- LOS ANGELES — A California state court judge on Nov. 10 issued a tentative decision denying the City of Claremont’s eminent domain lawsuit over Golden State Water Co., finding that the water company rebutted statutory assumptions that “‘the public interest and necessity require’ the taking and that the City’s taking is ‘a more necessary use’” (City of Claremont v. Golden State Water Company, et al., No. BC 566125, Calif. Super., Los Angeles Co.).
