Montana Supreme Court Backs Water Court Interpretation Of 1906 Schuh Decree

(November 7, 2016, 9:36 AM EST) -- HELENA, Mont. — The Montana Supreme Court on Nov. 3 said the Montana Water Court did not err in its interpretation of a 1906 decree regarding downstream rights to water that flows into and is stored in a hydroelectric dam (Granite County Board of Commissioners v. Esther J. McDonald, No. DA 16-0126, Mont. Sup.; 2016 Mont. LEXIS 954).
