No Abrogation Of Immunity In Age Bias Statute, 11th Circuit Holds

Mealey's (October 21, 2016, 2:14 PM EDT) -- ATLANTA — Congress did not abrogate the sovereign immunity of Native American tribes in the Age Discrimination in Employment Act of 1967 (ADEA), the 11th Circuit U.S. Court of Appeals held Oct. 18 in affirming that an Alabama tribe’s immunity protects it from an age discrimination suit filed by a former tribal employee (Christine J. Williams v. Poarch Band of Creek Indians, No. 15-13552, 11th Cir.; 2016 U.S. App. LEXIS 18717).
