Company Tells Top Court Retroactive Adjudication Of Black Lung Cases Violates ACA

Mealey's (May 26, 2015, 5:47 PM EDT) -- WASHINGTON, D.C. — The Department of Labor violated the clear intent of the Patient Protection and Affordable Care Act (ACA) in allowing retroactive adjudication of Black Lung Benefits Act claims, a mining company told the U.S. Supreme Court on April 22 (Peabody Coal Co. v. Director, Office of Workers’ Compensation Programs, United States Department of Labor and Eva Elizabeth Hill, No. 14-1278, U.S. Sup.).
