Government Asks Court To Dismiss Blue Cross’ Risk Corridor Nonpayment Suit

(October 18, 2016, 1:32 PM EDT) -- WASHINGTON, D.C. — Nothing in the Patient Protection and Affordable Care Act (ACA) requires annual risk corridor payments and both jurisdiction and ripeness are thus lacking, the United States told a U.S. Federal Claims judge on Sept. 30 in urging him to dismiss the action (Blue Cross and Blue Shield of North Carolina v. The United States of America, No. 16-651, Fed. Clms.).
