BIA Vacates Decision On Enrollment Ordinance, Says Appeal Must Be Considered

Mealey's (July 15, 2015, 11:46 AM EDT) -- ARLINGTON, Va. — The U.S. Department of the Interior’s (DOI) Board of Indian Appeals on July 13 vacated a decision enacting an ordinance amending the Nooksack Tribe’s enrollment ordinance to eliminate a provision in the tribe’s constitution that had extended membership to people possessing at least one-fourth degree Indian blood and who could prove Nooksack ancestry to any degree, saying the procedural decision was incorrect because an appeal by tribal members was not taken into consideration (Two Hundred and Seventy-One Enrolled Nooksak Indians v.
