Oregon Water District Moves To Dismiss Takings Lawsuit For Lack Of Jurisdiction

(September 7, 2016, 12:45 PM EDT) -- PENDLETON, Ore. — An Oregon water district on Aug. 19 asked a federal court to dismiss a lawsuit by water users alleging an unconstitutional taking of their water, saying the plaintiffs failed to exhaust their available state court remedy and that the district has sovereign immunity from lawsuit (ELH LLC, et al. v. Westland Irrigation District, No. 16-1318, D. Ore., Pendleton Div.).
