3rd Circuit: Transfer Before Class Certification Motion Doesn’t Moot Claims

(August 2, 2016, 10:12 AM EDT) -- PHILADELPHIA — The transfer of an inmate after he filed a class complaint alleging violations of his constitutional rights while he was housed at the U.S. Penitentiary (USP) at Lewisburg but before he moved for class certification does not moot his class claims, the Third Circuit U.S. Court of Appeals ruled July 15, vacating a district court’s dismissal of the class claims (Sebastian Richardson v. Director Federal Bureau of Prisons, et al., No. 15-2876, 3rd Cir.; 2016 U.S. App. LEXIS 12997).
