Oracle Says Jurisdiction Choice Waived Immunity In ACA Exchange Spat
(July 22, 2016, 12:10 PM EDT) -- PORTLAND, Ore. — An agreement’s language establishing the jurisdiction in which any legal dispute would be settled waived immunity from copyright infringement claims arising from a spat over Oregon’s Patient Protection and Affordable Care Act (ACA) insurance exchange, Oracle told the Ninth Circuit U.S. Court of Appeals on July 12 (Oracle America Inc. v. The Oregon Health Insurance Exchange Corp., dba Cover Oregon, et al., Nos. 15-35950, 15-35975, 9th Cir.).
