Mealey's (August 9, 2019, 9:54 AM EDT) -- SAN FRANCISCO — A group of plaintiffs alleging violation of the Illinois Biometric Information Privacy Act (BIPA) via Facebook Inc.’s photo-tagging feature may proceed with their lawsuit, a Ninth Circuit U.S. Court of Appeals panel ruled Aug. 8, affirming a class certification ruling and finding that the plaintiffs alleged a concrete privacy injury-in-fact, establishing their standing under Article III of the U.S. Constitution (Nimesh Patel, et al. v.
