ACA Forecloses On Review Of HHS Hospital Expansion Decision, Judge Says

(July 19, 2016, 1:25 PM EDT) -- WASHINGTON, D.C. — The process used by the U.S. Department of Health and Human Services (HHS) in permitting expansion of a physician-owned Texas hospital is inseparable from the decision itself and not subject to review after Patient Protection and Affordable Care Act (ACA) amendments, a federal judge in the District of Columbia held June 28 (Knapp Medical Center, et al. v. Sylvia Matthews Burwell, et al., No. 15-1663, D. D.C.; 2016 U.S. Dist. LEXIS 83568).
