Federal Judge Affirms Secretary’s Authority To Take Land Into Trust For Tribe

Mealey's (June 24, 2015, 10:22 AM EDT) -- WASHINGTON, D.C. — A federal judge in the District of Columbia on June 16 granted summary judgment in favor of the Match-E-Be-Nash-She-Wish Band of Pottawatomi Indians, holding that the plaintiff’s constitutional rights were not violated and that the secretary of the Interior had the authority to take land into trust for the tribe to build a casino (David Patchak v. Sally Jewell, No. 08-1331, D. D.C.; 2015 U.S. Dist. LEXIS 78553).
