Chinese Company Asks High Court To Review Obviousness Test In DuPont Patent Case
(June 30, 2016, 11:59 AM EDT) -- WASHINGTON, D.C. — A chemicals manufacturer on June 9 petitioned the U.S. Supreme Court to review whether the Federal Circuit U.S. Court of Appeals erred in affirming the use of what the company says is an overly rigorous standard as part of a determination that a E.I. du Pont de Nemours & Co. thermal plates patent is not obvious (MacDermid Printing Solutions, LLC v. E.I. DuPont De Nemours & Co., No. 15-1499, U.S. Sup.).
