New York Justice: Reinsurer Did Not Waive Late-Notice Defense In Asbestos Suit

(June 30, 2016, 10:10 AM EDT) -- NEW YORK — A New York justice on June 17 determined that a reinsurer did not waive its right to assert a late-notice defense in an asbestos coverage dispute because the documents produced by the insurer are not sufficient to prove that the reinsurer was promptly notified that the insurer’s excess policy could be exhausted by an asbestos settlement entered into by the insurer on behalf of an insured (Granite State Insurance Co. v.
