Agency: Anti-Fracking Groups Not Entitled To Fees; Some Objections Not ‘Moot’

Mealey's (June 18, 2015, 4:40 PM EDT) -- HARRISBURG, Pa. — The Pennsylvania Department of Environmental Protection (DEP) on Sept. 25, 2014, filed a brief with the Pennsylvania agency that governs hydraulic fracturing permit appeals, concurring with a group of environmental advocacy organizations that part of the DEP’s argument that it followed appropriate laws in granting a fracking permit was moot. However, the DEP argues that its other defenses remain valid, and it says that the environmental groups are not entitled to attorney fees (The Delaware Riverkeeper Network, et al. v. Commonwealth of Pennsylvania, et al. [in re: XTO Energy Inc.], No. 2014-101, Pa. EHB)....
